Terms of sale
1. Business data and property
1.a) The website www.primato.it is managed by Primato Sport Italia Srl, Via dell'Industria 7/A, 22070 Montano Lucino (CO), Vat n. 01378930133.
1.b) In this agreement the website www.primato.it will be called “Site”, while the company Primato Sport Italia Srl will be referred to as “Company”.
2. Descriptions and images
2.a) All descriptions and product images visible on the website are accurate and updated.
2.b) The images can differ in comparison with the dispatched goods in reference to color, shape and size because of the setting of the monitor.
3. Orders acceptance
3.a) By placing the order on the website, the customer claims to have read the conditions of sale, the payment methods proposed and the whole process.
3.b) The Company has the right to not accept the proposal without owing anything to the customer making the request in any way. It excludes any right of the client to any compensation, and contract or tort liability for direct or indirect damages to persons or property, caused by the rejection of the order proposed.
4.a) The Company is committed to send the purchased products on the website as quickly as possible, in any event within 1 business day after payment confirmation.
4.b) The shipping address is the one indicated by the customer during the order issue, unless otherwise agreed in writing between the parties. Under no circumstances we will ship to PO boxes, mail boxes and similar things. For the shipment pick up is required the signature of an adult.
4.c) In case of package manumission, if the customer will accept the goods sent without any objection to the carrier about packing and / or content, he will assume all risks and consequences, so he will automatically exempt the carrier that he has delivered the package and the Company. So at the delivery, the customer must verify the integrity of the package. If the package is damaged, the client is asked to reject the package to the sender without accepting the receipt, or he could open it in front of delivery person in charge, and if it is necessary, he could make a written complaint to the courier. In all these cases, the customer will also be asked to immediately notify the Company by e-mail at email@example.com or by telephone at +39 031.4451070. If the customer decides to accept the package even if it is damaged, the Company shall not be held liable for any shortfall in the contents of the shipment.
4.d) In case of lost / stolen item, the Company, upon the claim receipt and did not find an agreement to replace the goods lost, will refund only than anticipated by the customer in the shortest as possible but no later than 15 working days by bank transfer to the coordinates that will be provided by the customer. The refund will always be payable only to the person who had made the payment and under no circumstances to other parties, even in the case of gifts to third persons.
4.e) No compensation can be attributed or required to the Company in case of order delay or ordered goods delivery delay. The customer cannot refuse the receipt of the shipment if not in case of tampering, alteration, or on suspicion of damage to contents caused by an obvious change in the package, in which case it will be asked to reject it.
5.a) The Company accepts payments in the following ways:
- Bank transfer to the bank details transmitted when ordering. In the reason of payment must always be the client name and surname together with the purchase order number as shown on video, completed the purchase process, and as indicated in the next order confirmation e-mail.
- Credit card (Visa, Mastercard, Postepay), through the gateway bank arranged by Banca Sella. The client credit card data are not in any way aware of the company, but only reside on secure payment servers of Banca Sella.
5.b) The prices indicated on the website are in Euro and they include VAT. Where the VAT is not due, it will be clearly stated at time of purchase.
5.c) If the customer delays in the payment of the agreed amount, the Company will solicit the execution. If the amount due is not paid within 5 working days from the order receipt, the Company reserves the right to consider void the purchase order making the same goods of order available again for purchase by others.
6. Guarantees and assistance
6.a) All products purchased from the Company are covered by a guarantee of origin of defects and manufacturing.
6.b) For any additional assistance, customers should contact the Company by phone at +39 031.4451070 or by email to firstname.lastname@example.org, and of course in person at the shop point of the Company.
7.a) The customer not satisfied of the purchase can exercise the right of withdrawal in accordance with current legislation of distance selling, more in detail of Dlgs No. 206 of 2005 (Consumer Code) and he must send by a round trip registered letter a notice to that effect within 15 days of receipt of goods. The customer is asked to bring forward this communication to the Company by e-mail at email@example.com. The round trip registered letter must be sent to: Primato Sport Italia Srl, Via dell'Industria 7/A, 22070 Montano Lucino (CO).
7.b) The right of withdrawal is subject to the following conditions: the products must not have been worn and must not show signs of wear, abrasions or scratches that can compromise the goods reselling in the conditions of “New”. The goods must be returned to the sender complete in all their parts, accessories in general, packaging, and with any piece however received from the customer by the Company.
7.c) The return must take place in a single shipment and never in separate shipments to revocation of the right itself.
7.d) As required by law, the goods subject to withdrawal travel at the risk and expense of the customer, which is therefore requested to agree by email or telephone the company the choice of mode of delivery appropriate for the case. The return shipping charges must be paid by the client who intends to use the right of withdrawal, except in the case of error by the Company, in which case they will be against him. There is no other case of expenses charged to the Company itself. The Company will reject any package for which is required by the courier or by the postman any cost of shipment and costs of any kind.
7.e) The package must be properly sealed and shipped to the address listed as the sender in the shipment of arrival, namely: Primato Sport Italia Srl, Via dell'Industria 7/A, 22070 Montano Lucino (CO). The package or the envelope should be properly sealed with gummed tape wrapping signed in all parts potentially inviolable in order to make unique and unrepeatable the package.
7.f) In case of obvious package tampering on returned goods receipt, the same will be rejected to give to the customer the possibility to take action against the carrier and give it over to the insurance procedure of the courier or of the post office.
7.g) The price paid refund will only be paid through the buyer bank account or post office account within 7 working days after the return acceptance.
8. Final disposition
By placing the order on the website, the customer claims to have read and approved the terms of the sale, the payment methods proposed and all the purchase process.
Any dispute arising between the Company and its customers, is as of now referred to as the competent Court of Como (CO).
